Can Brexit lawfully remove my EU citizenship?

Negotiations between the EU and the UK are, so it seems to me, proceeding on the implicit basis that UK citizens (who are at present also EU citizens) will lose their EU citizenship on the withdrawal date. The basis in law for the assumed removal of my EU citizenship is unclear. At least it is unclear to me. My EU citizenship was bestowed on me as a result of Article 9 of the Treaty on European Union. Article 50 provides for various matters which relate to the status of a Member State which wishes to withdraw but says nothing about the effect on the EU citizenship of nationals of that Member State after withdrawal. EU citizenship, so it seems to me, is an individual right which I and tens of millions of other UK citizens enjoy. Can the EU lawfully remove that individual right? If so, on what basis in EU Law can the EU do so? Can anyone point me to any point of EU Law which sheds light on this question?

Kill Brexit Now: Theresa May is "dim-witted and downright dishonest" on Brexit

Today I am distributing a media release on Theresa May's handling of Brexit. If you want to help make Theresa May's inept handling of Brexit better known please think about contacting your local media, write a letter to a newspaper or contact your new Member of Parliament after the Election. The possible ways to help get this message better known are endless. Here is the text of the media release FOR IMMEDIATE RELEASE Theresa May is “dim-witted and downright dishonest” on Brexit Today the centrepiece of Theresa May’s election strategy came under direct attack. A retired Scottish doctor, Dr. Andrew Watt, who is poised to launch a claim for Judicial Review immediately after the General Election called Theresa May’s Brexit strategy “dim-witted and downright dishonest”. On 29 th April Dr. Watt sent to the Prime Minister a Letter Before Action, the first formal step towards Judicial Review of Brexit, and has been in correspondence si...

Kill Brexit Now: Four questions the Prime Minister MUST answer

There is good evidence that Theresa May's supposed Article 50 Notification letter of 29th March 2017 is unlawful. The Independent today helpfully covered my invitation to Donald Tusk to become an Interested Party in the prospective Judicial Review of the Prime Minister's so-called notification of 29th March. Brexit: Theresa May's letter of notification to leave the EU is 'unlawful', declares judicial review to Brussels There are four questions the Prime Minister MUST answer: On what date did the United Kingdom make a "decision" which is compliant with Article 50(1) of the Treaty on European Union? Who made that "decision" compliant with Article 50(1)? What is the documentary evidence that any such decision was made? Do you now accept that your letter of 29th March 2017 to Donald Tusk was not a lawful Article 50 notification? The letter of 29th March is demonstrably unlawful on multiple grounds. The Prime Minister is deceiving the ...

Kill Brexit Now! - A brief outline of the proposed legal action: 1. The purported Article 50 Notification was unlawful (Queen's Consent)

In this post I want briefly to outline one strand of the legal action that I hope to begin (ideally with a group of like-minded individuals) at some point over the next few months. My aim here is simply to convey one line of legal argument in a form which is reasonably understandable to a layman. My contention is that no lawful "Notification" in the meaning of Paragraph 2 of Article 50 of the Treaty on European Union exists. If I'm correct that there is no lawful "Notification", then the whole "Brexit" process will inevitably collapse. The only question is when. On 29th March 2017 Theresa May sent to the European Union a letter which purported to be a "Notification" in the meaning of Paragraph 2 of Article 50 of the Treaty on European Union. That "Notification" was supposedly based on a "Decision" of the kind referred to in Paragraph 1 of Article 50 of the Treaty on European Union. Does such a "Decision...

One of the explicit aims of this blog is to gather a group of like-minded individuals to begin a legal challenge to the unlawful purported Article 50 Notification of 29th March 2017. By email: killbrexitnow@gmail.com On Twitter: @KillBrexitNow If you contact me by email please don't necessarily expect an immediate reply. There are times when I'm focussing on legal research or other reasons means that I may not check my email for many days at a time.

Kill Brexit Now! - The aims of this blog

So-called "Brexit" is causing huge damage to the United Kingdom and many of its citizens and residents. Theresa May's purported Article 50 notification of 29th March 2017 is unlawful. I therefore expect "Brexit" to come to an ignominious and messy end. The longer this unlawful and fatally flawed "Brexit" process continues the more damage that will be caused to the interests of the United Kingdom, its citizens and residents. The sooner "Brexit" is killed the better. Hence Kill Brexit NOW! As time allows I'll post further information about the lines of analysis that lead me to the conclusion that the purported Article 50 Notification is unlawful. The aims of this blog include the following: Undermining and correcting the false public and political perception that a lawful Article 50 notification has been sent by the United Kingdom. Gathering a group of like-minded individuals to begin a formal legal challenge to the suppos...
