FOR IMMEDIATE RELEASE

Theresa May is “dim-witted and downright dishonest” on Brexit

Today the centrepiece of Theresa May’s election strategy came under direct attack.

A retired Scottish doctor, Dr. Andrew Watt, who is poised to launch a claim for Judicial Review immediately after the General Election called Theresa May’s Brexit strategy “dim-witted and downright dishonest”.

On 29th April Dr. Watt sent to the Prime Minister a Letter Before Action, the first formal step towards Judicial Review of Brexit, and has been in correspondence since then with the Government Legal Department.

Dr. Watt has given the Government Legal Department a deadline of 17.00 on Thursday 8th June to respond to a number of important legal points.

Dr. Watt has raised seven potential grounds of claim with the Government Legal Department and will make a final decision on proceeding with a claim for Judicial Review once he has the Government Legal Department’s response which is due on the day of the General Election.

Dr. Watt said,

“I want to be in a position to launch a claim for Judicial Review as soon as possible after the General Election. I’m waiting for a response from Oliver Gilman and Matthew Alderton the Government lawyers who are dealing with my prospective claim.”

“The matter is increasingly urgent. The negotiations with the European Union are due to start on 19th June. The claim forms need to be submitted to the Administrative Court by 29th June if I am to be within the three month deadline for Judicial Review.”

“I first wrote to the Prime Minister on 14th April drawing her attention to my concerns that her letter of 29th March 2017 to the President of the European Council was unlawful and explaining some of the reasons why I thought so.”

“Nobody was more surprised than me when she called a General Election four days later.”

“Why do I say the Prime Minister is dim-witted? Her Government told Parliament that notification was the first step towards Brexit. That is nonsense. The first step towards a lawful Brexit is an Article 50(1) decision which explicitly has to be in accordance with the UK’s constitutional requirements. I will be arguing before the Administrative Court that no such decision has been made so there was nothing for Mrs. May to notify in her letter of 29th March. A six year old would know that paragraph 1 comes before paragraph 2. Dim-witted Theresa May seemingly hasn’t recognised the obvious.”

“Why do I say the Prime Minister is dishonest? She told Parliament that a decision had been made. Her Minister David Davis told the Divisional Court and the Supreme Court that a decision had been made using the Royal Prerogative.  It hasn’t.”

“The Department for Exiting the European Union has written to me telling me that the Article 50(1) decision was made in the Referendum of 23rd June 2016. The Supreme Court indicated that wasn’t legally effective as an Article 50(1) decision. I have asked the Government lawyers for evidence that a legally effective Article 50(1) decision has been made. So far they have refused to disclose documents about any supposed Article 50(1) decision. I suspect the requested documents don’t exist and that there has been no  decision which has legal effect.”

“My suspicion is that Theresa May has known for weeks that she is deceiving the British people about Brexit. The Judicial Review proceedings will be an opportunity to examine in detail Mrs May’s actions.”

“In my view Theresa May has perpetrated a constitutional confidence trick on the people of the United Kingdom. I believe her dishonesty on Brexit means she must resign. The only question in my mind is when the Prime Minister will do the decent thing.”

Notes for editors:

Dr. Andrew Watt asks that he be identified only as a “retired Scottish doctor”, in view of the threats to the personal safety of Gina Miller and others. Dr. Watt also wishes to point out that supposed biographical details included in previous media articles are inaccurate.

Dr. Watt will not be giving interviews before the General Election but written questions may be submitted to him at killbrexitnow@gmail.com.

Dr. Watt is also willing to make available to interested journalists copies of the Letters Before Action which he has sent to the Prime Minister and the Government Legal Department. Those too may be sought via killbrexitnow@gmail.com.
