The "Kill Brexit Now" Judicial Review - Are you an Interested Party?

Tens of millions of UK citizens have been or will be affected by the Brexit Madness which is sweeping the country.

I'm seeking to have a UK Court (and the Court of Justice of the European Union) carefully examine 19 legal issues which lead me to believe that the Prime Minister and others have acted unlawfully in the steps taken towards Brexit.

The Prime Minister's legal mistakes have, in my estimation, effects in Civil Law and in Criminal Law.

If you are someone who is a UK citizen it is likely that you are an "Interested Party" in the "Kill Brexit Now" Judicial Review.

If you have a business in the UK or in the EU which has had to make contingency plans to cope with the uncertainty generated by Brexit, you may be an Interested Party.

As the prospective Claimant in the Judicial Review the Pre-Action Protocol for Judicial Review indicates that I should inform people who are affected by the Judicial Review that they are "Interested Parties".

The practical problem facing me is that there are tens of millions of Interested Parties - individuals in the UK and abroad.

Also thousands of businesses too which are, in my assessment, wasting their time making plans and spending money on a Brexit that is unlawful and is therefore doomed to fail.

Individuals and businesses who have suffered financial loss can, if my legal reasoning is correct, sue the Government for damages on grounds similar to those in the famous Factortame case.

If you think you might be an Interested Party in the "Kill Brexit Now" Judicial Review you have, as I understand the Pre-Action Protocol for Judicial Review, a right to receive a copy of the response from the Government Legal Department to my Letter Before Claim.

If you want to receive a copy of the Government Legal Department's formal response I suggest you contact the relevant lawyers in the Government Legal Department to ask for a copy of the Prime Minister's formal response.

The lawyers I have been in correspondence with are Oliver Gilman ( oliver.gilman@governmentlegal.gov.uk ) and Matthew Alderton ( matthew.alderton@governmentlegal.gov.uk ).

A polite email to Mr. Gilman or Mr. Alderton indicating that you believe that you might be an Interested Party in the "Kill Brexit Now" Judicial Review and asking for a copy of the Prime Minister's formal response should do the trick.

I have given the Government Legal Department until 17.00 on Wednesday 11th October to respond formally to the Letter Before Claim.

Given the range and complexity of the legal arguments contained in the Letter Before Claim it's entirely possible that the Government Legal Department will ask for an extension of that deadline. So it may be a little time before you receive a copy of the Government Legal Department's formal response to the Letter Before Claim.

If I am incorrect as to the Government Legal Department's duty to make their response available to you no doubt Mr. Gilman or Mr. Alderton will let you know.

The "Kill Brexit Now" Judicial Review will sink or swim on the basis of the quality (or otherwise) of the legal arguments which I have put forward in the Letter Before Claim.

Those legal arguments are seriously intended. I am sure that with more work on my part I can more effectively communicate them to a Court at a later stage in the Judicial Review process.

  1. I may not be a business but i still contend that millions like me will be adversely affected by Brexit. We made major life changing decisions based upon being UK/EU nationals and our homeland being a member of the EUropean Union. Those decisions and long term plans are now in serious jeopardy and could if it continues on its present course be financially disastrous to me and y family as well millions of other like minded people throughout EUrope. We have made our homes in the EU raised families got jobs and retired on the basis of a long term plan and allt eh acquired rights afforded to us via the EUs legislation over the past 40 yrs. I refuse to be restricted and have those rights denied in future due to an illegal, and advisory only consultative referendum which in my view is an unconstitutional act which has never been passed by parliament - further that the lies and misinformation shown by the leave campaign constitutes a major act of deliberate deception. On top of that i feelour MPs have failed the vast majority of the british people at home and abroad
